Terms of Service

These Terms of Service and Product Licence govern access to JabberwockyAI.com and the purchase, download, installation, access, or use of any Jabberwocky AI product, app, software utility, Minecraft Education world, map, skin pack, lesson resource, educator guide, media file, template, or other digital creation.

Jabberwocky AI is an independent creative education and game-based learning studio in New Brunswick, Canada.

By accessing the website, completing a purchase, accepting delivery, downloading a file, installing an app, or using a product, the purchaser and each authorized user agree to these Terms. If you purchase for a school, district, organization, government body, or other entity, you confirm that you have authority to accept these Terms for that entity.

1ORDER OF TERMS

These Terms apply together with the product page, the licence level selected at checkout, the Refund Policy, and the Privacy Policy.

If a product page or written licence agreement contains more specific terms, those specific terms control for that product. A purchase order or internal procurement document does not change these Terms unless Jabberwocky AI expressly agrees in writing.

2LICENCE GRANT — NOT A SALE OF OWNERSHIP

Subject to payment and compliance with these Terms, Jabberwocky AI grants the purchaser a limited, non-exclusive, non-transferable, non-sublicensable licence to use the purchased product only within the people, sites, organization, territory, duration, and purpose covered by the licence selected at checkout.

The licence is perpetual only when the product page expressly describes it as perpetual. Purchasing a product does not transfer copyright, ownership, source files, development materials, branding, or any other intellectual property right.

3LICENCE SCOPE

• Individual or educator licence
• Use by one named purchaser or educator. It does not permit shared departmental, school-wide, district-wide, organizational, or public distribution.

• School or site licence
• Use by authorized staff and learners at one named school or physical site, if that licence is offered for the product.

• District, organization, or system licence
• Use by authorized staff and learners within the single purchasing district, organization, or system identified in the order. It does not extend to another district, affiliated organization, separate legal entity, province, or external partner.

• Provincial, regional, or enterprise licence
• Use within the single province, region, enterprise, or jurisdiction identified in the order, subject to any limits stated on the product page or in a written agreement.

The purchaser is responsible for choosing the correct licence and for ensuring that every copy, installation, deployment, and user remains within its scope.

4PERMITTED EDUCATIONAL USE

Authorized educators may use the product for teaching, professional learning, demonstrations, and learner activities within the purchased licence scope.

Educators may make reasonable internal copies of educator-facing guides, worksheets, or support materials for authorized users where the product is intended for classroom use. This permission does not allow public posting, open-web distribution, resale, publication, or sharing with people or organizations outside the purchased scope.

Students may access and use a product only through the licensed educator or institution and only for the supervised educational purpose for which it was provided.

5PROHIBITED COPYING AND DISTRIBUTION

Unless Jabberwocky AI gives prior written permission, you must not:

• sell, resell, rent, lease, sublicense, gift, transfer, or commercially distribute a product;
• share product files, download links, licence keys, passwords, access credentials, or cloud folders outside the licensed scope;
• upload a product or any substantial part of it to a public website, public repository, file-sharing service, marketplace, server, shared library, or generative-AI service;
• make a product available for public download or access, including through a publicly accessible Minecraft server or similar service;
• copy, extract, republish, or reuse maps, worlds, code, models, textures, skins, artwork, images, audio, video, lesson content, documentation, datasets, or other product components as standalone assets;
• remove or obscure copyright notices, attribution, watermarks, trademarks, licence information, or technical protection measures; or
• permit an unlicensed person or organization to obtain or retain a copy.

6MODIFICATION, DERIVATIVE WORKS, AND COMPETING PRODUCTS

Where a product is designed for learner building or educator adaptation, authorized users may modify working copies for internal educational activities within the licence scope.

That permission does not transfer ownership and does not permit distribution of the original or modified product outside the licence scope.

You must not use a product or its components to create, train, market, or distribute a competing product, substitute collection, commercial derivative, asset pack, dataset, model, template, or service. You must not use product files or content to train, fine-tune, evaluate, or populate an artificial-intelligence or machine-learning system without prior written permission.

7SOFTWARE RESTRICTIONS

Except to the limited extent that applicable law does not permit the restriction, you must not reverse engineer, decompile, disassemble, translate, bypass, defeat, or attempt to discover the source code, algorithms, keys, security controls, or non-public operation of any Jabberwocky AI app or utility.

You must not introduce malware, automate abusive access, probe for vulnerabilities, interfere with operation, circumvent usage limits, or use the website or products to gain unauthorized access to any system, account, or data.

8OWNERSHIP AND INTELLECTUAL PROPERTY

Jabberwocky AI and its licensors retain all right, title, and interest in the website and products, including their software, world design, maps, layouts, selection and arrangement, lesson materials, written content, graphics, media, product names, branding, improvements, and updates.

Copyright and other intellectual property rights apply even when a product is editable, downloadable, supplied without digital-rights management, or used in an educational setting.

No implied licence is granted. Rights not expressly granted are reserved by Jabberwocky AI and its licensors.

9COPYRIGHT AND TRADEMARK NOTICES

Jabberwocky AI product packaging, documentation, and distributed files may include copyright, trademark, attribution, or licence notices. These notices must remain intact on all permitted copies.

Jabberwocky AI names, logos, product names, trade dress, and distinctive branding may not be used to imply authorship, sponsorship, endorsement, partnership, or affiliation without prior written permission.

10THIRD-PARTY PLATFORMS AND MATERIALS

Jabberwocky AI is an independent business. Unless a specific written agreement or product page expressly states otherwise, Jabberwocky AI is not affiliated with, endorsed by, sponsored by, approved by, authorized to speak for, or acting on behalf of any gaming company, platform owner, government, school district, educational institution, or other third party. This includes Microsoft, Mojang, Minecraft, Minecraft Education, Epic Games, and Fortnite.

Third-party names, marks, platforms, institutions, projects, and places identify compatibility, context, customers, collaborators, or subject matter only. They do not state or imply third-party authorship, sponsorship, approval, endorsement, partnership, or affiliation. All third-party names, marks, and logos belong to their respective owners.

A product may contain or depend on third-party materials governed by separate terms. Those terms continue to apply to the third-party materials and do not expand your rights in Jabberwocky AI content.

11ACCOUNTS, DELIVERY, AND SECURITY

Products may be delivered through Gumroad or another commerce or file-delivery provider. The purchaser must provide accurate information and protect the purchase email, receipt, download link, account credentials, and delivered files from unauthorized access.

You must promptly notify Jabberwocky AI if a product, link, key, or credential is lost, exposed, or used outside the licence scope. Replacement access may require purchase verification.

12PAYMENT PROCESSING

Product and licence information may open in an overlay over JabberwockyAI.com, but Gumroad operates the final checkout page and handles payment processing, applicable taxes, receipts, and digital delivery. Gumroad's terms and privacy practices also apply to those services.

Jabberwocky AI does not collect or store payment-card numbers. Prices and the selected licence shown at the final checkout should be reviewed before payment is submitted.

13EDUCATOR AND INSTITUTION RESPONSIBILITIES

Educators and institutions are responsible for determining suitability for their learners, curriculum, age group, accessibility needs, devices, network, accounts, policies, and legal obligations.

They are also responsible for supervision, instructional decisions, learner safety, account management, privacy compliance, permissions, backups, and ensuring that student work does not expose personal or confidential information.

14USER CONTENT AND STUDENT DATA

Unless a product expressly states otherwise, Jabberwocky AI products do not require users to submit student personal information to Jabberwocky AI.

Users retain responsibility for content they create, enter, import, or share while using a product. Users must have the rights and permissions needed for that content and must not include unlawful, infringing, confidential, or unnecessary personal information.

15ACCEPTABLE USE

You must not use the website or a product to violate law, infringe intellectual property or privacy rights, harass or harm others, create or distribute malicious content, facilitate fraud, misrepresent authorship, or interfere with another person's systems or rights.

Products must not be used in a way that creates a false statement of endorsement by Jabberwocky AI, a featured institution, a government body, or a third-party platform.

16AI-ASSISTED FEATURES

Some products may include AI-assisted functionality or workflows. AI-generated or AI-assisted output may be incomplete, inaccurate, biased, or unsuitable for a particular purpose. Users must review and verify output before relying on it, especially for educational, safety, legal, financial, or other consequential decisions.

Third-party AI services may impose their own terms, privacy rules, age requirements, usage limits, or fees.

17COMPATIBILITY AND THIRD-PARTY CHANGES

Some products require compatible software, hardware, operating systems, subscriptions, accounts, storage, or third-party services. Customers must review the stated requirements before purchase.

Third parties may change software, file formats, APIs, services, policies, or technical requirements without notice. Jabberwocky AI does not control those changes and cannot guarantee permanent compatibility.

18UPDATES, SUPPORT, AND AVAILABILITY

Unless a product page or written agreement expressly promises ongoing updates or a support period, a purchase covers the version delivered at the time of purchase.

Jabberwocky AI may update, correct, replace, rename, suspend, or discontinue products or services. We may use reasonable anti-abuse, security, download, and delivery controls.

19LICENCE VERIFICATION AND ENFORCEMENT

Jabberwocky AI may request reasonable information necessary to confirm a purchase, authorized entity, or licence scope when investigating suspected misuse or providing support.

If a user materially breaches these Terms, the licence may be suspended or terminated after notice where reasonable. Upon termination, unauthorized use must stop and unauthorized copies must be deleted. Clauses concerning ownership, restrictions, liability, and remedies survive termination.

Unauthorized copying or distribution may cause harm that cannot be fully remedied by money alone. Jabberwocky AI may seek available injunctive or other legal relief in addition to any other remedies.

20REFUNDS AND CONSUMER RIGHTS

Refund requests are governed by the Jabberwocky AI Refund Policy.

Nothing in these Terms excludes, restricts, or overrides a statutory warranty, refund right, consumer-protection right, or other legal protection that cannot lawfully be excluded in the customer's jurisdiction.

21DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website and products are provided on an “as is” and “as available” basis.

Jabberwocky AI does not promise uninterrupted or error-free operation, permanent third-party compatibility, a particular educational outcome, fitness for every environment, or that all content will remain current after delivery.

22LIMITATION OF LIABILITY

To the fullest extent permitted by law, Jabberwocky AI will not be liable for indirect, incidental, special, exemplary, punitive, consequential, loss-of-data, loss-of-revenue, loss-of-opportunity, or business-interruption damages arising from the website or a product.

To the fullest extent permitted by law, Jabberwocky AI's aggregate liability arising from a product will not exceed the amount paid to Jabberwocky AI for that product during the twelve months before the event giving rise to the claim.

These limitations do not apply where liability cannot lawfully be excluded or limited.

23INDEMNITY

To the extent permitted by law, an organization purchasing or using a product agrees to defend and indemnify Jabberwocky AI against third-party claims arising from that organization's unlawful use, unauthorized distribution, breach of licence scope, infringement caused by content it supplies, or violation of these Terms.

This section does not require a consumer to indemnify Jabberwocky AI where such a requirement is prohibited by law.

24GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of New Brunswick and the federal laws of Canada applicable there, without regard to conflict-of-law rules.

Subject to mandatory rights in the user's jurisdiction, the courts located in New Brunswick, Canada will have exclusive jurisdiction over disputes arising from these Terms or a product.

Before starting formal proceedings, the parties should make a reasonable effort to resolve the concern through direct written communication.

25GENERAL TERMS

If any provision is found unenforceable, the remaining provisions continue in effect and the affected provision will be limited to the minimum extent necessary.

A failure to enforce a provision is not a waiver. The purchaser may not assign or transfer the licence without prior written consent. Jabberwocky AI may assign these Terms as part of a merger, reorganization, sale, or transfer of its business or assets.

These Terms, the product page, the selected licence, and the policies incorporated above form the entire agreement concerning the purchase and use of the product unless a separate written agreement signed by Jabberwocky AI applies.

26CHANGES TO THESE TERMS

Jabberwocky AI may update these Terms for future website use and purchases. The version in effect when a product is purchased will generally govern that purchase, except where a change is required by law or mutually agreed.
